V\u00e9lez afirm\u00f3 que su El nuevo jefe, Raymond Perry, la invit\u00f3 a salir, la mir\u00f3 fijamente, hizo comentarios sobre que le gustaban las mujeres latinas, sugiri\u00f3 un tr\u00edo con \u00e9l y su novia e hizo comentarios inapropiados sobre su cuerpo y apariencia. V\u00e9lez aleg\u00f3 que se quej\u00f3 ante recursos humanos sobre las acciones de Perry al menos 10 veces sin que la empresa tomara ninguna medida. Toda esta conducta se produjo en un corto per\u00edodo de tiempo. El 1 de abril de 2011, V\u00e9lez fue despedido por una supuesta ca\u00edda en el negocio.<\/p>\n<p>En abril de 2014, un jurado del condado de Essex fall\u00f3 a favor de Marilyn V\u00e9lez y le otorg\u00f3 una indemnizaci\u00f3n de $575.000 por acoso sexual y represalias, sin creer en las defensas de la empresa. El jurado otorg\u00f3 $75,000 por su reclamo por ambiente de trabajo hostil, $200,000 por su reclamo de represalias contra RockTenn y $250,000 por su reclamo de represalias contra Perry, su exjefe. Esta indemnizaci\u00f3n no incluye los honorarios del abogado de V\u00e9lez.<\/p>\n<p>El jurado no acept\u00f3 el motivo del despido de la empresa a pesar de lo siguiente: \u201cA principios de 2011, las ventas de RockTenn comenzaron a disminuir, siendo marzo de 2011 el peor mes registrado por la empresa. A pesar de la supuesta disminuci\u00f3n del negocio, los registros mostraron que el demandante trabaj\u00f3 horas extras varias veces durante este per\u00edodo. No obstante, el vicepresidente regional, Robert O&#039;Connell, orden\u00f3 a los gerentes que redujeran los costos de mano de obra y materiales. Inicialmente, Perry consider\u00f3 despedir a otro CSR con problemas de desempe\u00f1o, pero finalmente decidi\u00f3 despedir al demandante, el miembro m\u00e1s nuevo del departamento, e hizo esa recomendaci\u00f3n a la alta gerencia\u201d. El administrador individual fue declarado exclusivamente responsable de los da\u00f1os y perjuicios.<\/p>\n<p>Adem\u00e1s, la Divisi\u00f3n de Apelaciones determin\u00f3 que el acoso de Perry a otros empleados, no a V\u00e9lez, fue admitido adecuadamente por el tribunal de primera instancia para demostrar que la pol\u00edtica contra el acoso de la empresa era ineficaz.
