The FAA specifically exempts transportation workers\nlike truck drivers from this general requirement. The New Jersey Arbitration\nAct does not include an exemption for transportation works a New Jersey appeals\ncourt recently ruled. Colon v. Strategic Delivery Solutions, LLC, No.\nA-2378-17T4 (N.J. Super. Ct. App. Div. June 4, 2019).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The plaintiffs in\nColon were transportation workers with independent contractor agreements\ncontaining arbitration clauses expressly referencing the FAA. The agreements\ndid not mention the NJAA. The plaintiffs filed a complaint alleging violations\nof the New Jersey Wage and Hour Law and New Jersey Wage Payment Law.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case was remanded\nwith instructions to determine whether the plaintiffs, independent\ncontractor-drivers, were covered by the FAA\u2019s exemption for \u201ctransportation\nworkers,\u201d consistent with the U.S. Supreme Court\u2019s New Prime, Inc. v. Oliveira,\nNo. 17-340 (Jan. 15, 2019). The Court went on to say if the trial court finds\nthese plaintiffs to be transportation workers exempt from the FAA, the\nplaintiffs still may arbitration their claims under the state arbitration law.\nIronically, the following day a different panel of New Jersey\u2019s Appellate\nDivision said in Arafa v. Health Express Corp., No. A-1862-17T3 (June 5, 2019),\nthat a driver may pursue his wage and hour claims in court without discussing\nthe NJAA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FAA states that it\n\u201cshall not apply to contracts of employment of [\u2026] any other class of workers\nengaged in foreign or interstate commerce.\u201d In New Prime, the Supreme Court\nheld that the FAA\u2019s transportation worker exception applies to independent\ncontractor agreements between companies and transportation workers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Colon, the New\nJersey\u2019s Appellate Division held that the NJAA provided a basis to enforce an\narbitration agreement between a company and independent contractors. The Court\nsaid arbitration was appropriate even though the agreement did not expressly\nreference the NJAA because the statute applies to all arbitration agreements in\nNew Jersey made on or after January 1, 2003.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The attorneys at\nVlasac &amp; Shmaruk recommend having a qualified employment attorney review\nany arbitration agreements.
