Pero los empleadores deben mantener un cierto est\u00e1ndar de pr\u00e1ctica cuando se trata de contratar y mantener pasantes. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Los empleados que realizan trabajos deben recibir salarios a menos que califiquen como pasantes. En enero de 2018, el Departamento de Trabajo adopt\u00f3 una prueba de beneficiario principal para determinar si una pasant\u00eda puede ser \u201cno remunerada\u201d. Si el empleador es el \u201cbeneficiario principal\u201d, se debe pagar al pasante. Si el pasante es el \u201cbeneficiario principal\u201d, es posible que no reciba remuneraci\u00f3n.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Los factores de prueba del beneficiario principal incluyen:&nbsp; <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>la medida en que el pasante y el empleador entienden claramente que no hay expectativas de compensaci\u00f3n; <\/li><li>la medida en que la pasant\u00eda proporciona una formaci\u00f3n similar a la que se impartir\u00eda en un entorno educativo, incluida la formaci\u00f3n cl\u00ednica y otra formaci\u00f3n pr\u00e1ctica proporcionada por una instituci\u00f3n educativa; <\/li><li>el grado en que la pasant\u00eda est\u00e1 vinculada al programa de educaci\u00f3n formal del pasante mediante cursos integrados o la recepci\u00f3n de cr\u00e9dito acad\u00e9mico; <\/li><li>la medida en que la pasant\u00eda se adapta a los compromisos acad\u00e9micos del pasante al corresponder al calendario acad\u00e9mico; <\/li><li>la medida en que la duraci\u00f3n de la pasant\u00eda se limita al per\u00edodo en el que la pasant\u00eda proporciona al pasante un aprendizaje beneficioso;<\/li><li>&nbsp;la medida en que el trabajo del pasante complementa, en lugar de desplazar, el trabajo de los empleados remunerados y al mismo tiempo proporciona beneficios educativos significativos al pasante; <\/li><li>y la medida en que el pasante y el empleador entienden que la pasant\u00eda se lleva a cabo sin derecho a un trabajo remunerado al finalizar la pasant\u00eda.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Si un estudiante en pr\u00e1cticas solo realiza tareas menores y presenta documentos, se le debe pagar el salario m\u00ednimo y tiempo y medio por todo el tiempo trabajado m\u00e1s de cuarenta horas en una semana laboral.
