Estas actividades pueden estar protegidas por leyes federales y estatales sobre denuncia de irregularidades, o leyes contra la discriminaci\u00f3n. La EEOC informa que 51,61 TP3T de todos los cargos presentados en el a\u00f1o fiscal de 2018 fueron reclamaciones de represalias en el lugar de trabajo. Estos reclamos generalmente se rigen por una de estas leyes federales, estatales o locales aprobadas para garantizar la protecci\u00f3n de los empleados individuales:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Seguridad y salud en el trabajo (OSHA)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Raza, sexo, origen nacional, religi\u00f3n y color (todos bajo el T\u00edtulo VII de la Ley de Derechos Civiles de 1964 o la Ley de Igualdad Salarial)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Organizaci\u00f3n sindical (Ley Nacional de Relaciones Laborales)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Edad (Ley de Discriminaci\u00f3n por Edad en el Empleo)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Beneficios a los empleados (ERISA)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Discapacidad (Ley de Estadounidenses con Discapacidades)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Licencia familiar y m\u00e9dica (Ley de Licencia Familiar y M\u00e9dica)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Comisi\u00f3n de Bolsa y Valores de EE. UU. (Ley Sarbanes-Oxley y Ley Dodd-Frank)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Cuestiones salariales y horarias (Ley de Normas Laborales Justas)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Participaci\u00f3n formal en un procedimiento legal que involucre al empleador, como presentar un cargo ante la EEOC, testificar o \u201cayudar\u201d de otro modo en un procedimiento; o<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 \u201cOponerse\u201d de manera menos formal a cualquier conducta ilegal que tambi\u00e9n pueda estar sujeta a una disposici\u00f3n contra las represalias. La EEOC se\u00f1ala que protegi\u00f3 la actividad de \u201coposici\u00f3n\u201d. . . Incluye ampliamente las muchas formas en que un individuo puede comunicar\u201d su oposici\u00f3n expl\u00edcita o impl\u00edcita a la discriminaci\u00f3n laboral percibida. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Existen infinitas posibilidades de acciones que pueden considerarse represalias ilegales por parte de un empleador. Se puede presentar un reclamo incluso si no se ha presentado una queja ante el departamento de recursos humanos o la alta direcci\u00f3n.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Las represalias ilegales no tienen por qu\u00e9 estar relacionadas con el trabajo<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Las represalias pueden ser cualquier cosa que impida que un empleado denuncie acoso o cualquier otra actividad ilegal.
